Terms and Conditions

Conditions for using the car:

- The price of the rental car includes insurance and a standard deductible amount of  USD$ 500

- A deposit of USD$ 500 applies to the rental of the car.

- Loss of key (s) , broken window(s) , flat tire(s), broken chassis and fines are for the account of the renter.

- In the event of damages, the renter will at all times owe the deposit of USD$ 500. In the event of a breakdown, a collision or an accident, the contact person must be called at all times.

- Moving the car after a collision is NOT allowed; the damage caused to Paulina Car Rental as a result of the fact that the fault cannot be determined or cannot be determined properly, is for the renters own expense.

- All damage to the car is subject to a deductible and deposit as indicated above; this will be refunded if the damage has been fully recovered from a third party.

- When the car is returned the amount of fuel must be at least equal to that upon receiving the car. If not, the cost of the missing fuel will be charged plus a surcharge of USD$ 25.

- It is forbidden to use alcohol and / or narcotics and / or medication during or before the ride that (may) affect your ability to drive.

- The use of the car in (wet) swimwear is not permitted; damages or pollution caused by this is the sole responsibility of the user; diving equipment must be transported in plastic containers.

- You must leave the car tidy on departure (cleaned up).

- The amount of fuel must be at least equal to that on receipt when it is returned; if this is not the case, the costs of the missing fuel will be charged, plus a USD$ 25 surcharge.

- Smoking is not allowed in the car, nor is the use of a cell-phone by the driver, unless a hands-free kit is used.

By signing this user agreement, the driver (s) agree to the conditions as stated above.

Terms and Conditions Paulina Car Rental 

Article 1: The General Terms and Conditions of Paulina Car Rental apply to all rental agreements. The renter agrees with the terms and conditions of Paulina Car Rental. Only those people who have been designated as renter or (co) driver in the rental agreement may drive the vehicle. Driving the vehicle is only permitted for persons from the age of 23 and above, who are in possession of a valid driver's license. When concluding the rental agreement, identification by means of a driver's license and a passport is required. The renter is not permitted to make the vehicle available to a person who is not listed as a renter in the rental agreement. If the renter allows a third party to drive or use the vehicle with his approval, he will be held fully liable for all consequences and damages by him or the other person driving the car. 

Article 2: The rental period that is agreed upon at the final reservation is binding for both parties. The reservation is final from the moment Paulina Car Rental has received the down payment or the first installment of the rent. The rental agreement is entered into for the period and the rate as agreed in the final reservation. However, Paulina Car Rental reserves the right to refuse a renter without giving reasons. If the renter cancels the lease, the renter owes the full amount. The renter commits to paying the agreed rent, even if the car is picked up later or returned earlier.

Article 3: The renter is deemed to have received the car in good condition. Paulina Car Rental should deliver the car in good condition. The renter is obliged to make the rented property available to Paulina Car Rental again at the end of the rent in the same condition that it was accepted. If, on the day of delivery the vehicle is not delivered in the correct condition, that is, provided with all keys, documents and other items, Paulina Car Rental is entitled to charge the full rental amount for the car until the moment that all items have been completely returned to Paulina Car Rental. The renter hereby authorizes Paulina Car Rental, or a person designated by him to open the vehicle wherever the vehicle is located or to take possession of the car at the end of the rental period.

Article 4: The tenant must have paid the total rent, including the deposit, before the start of the rental period. If there is a long-term lease, the renter must have paid the first lease term, as well as the deposit, before the start of the lease. If the tenant does not pay the rent installments on time, he will owe default interest and contractual interest of 10% without further notice.

Article 5: Renting a car is at your own risk. The renter is liable for any form of damage to Paulina Car Rental, third parties and / or goods arising during the rental period. The renter indemnifies Paulina Car Rental against any form of damage to Paulina Car Rental, third parties and / or goods, occurring during the rental period. The renter indemnifies Paulina Car Rental against all fines, penalties and other measures that are imposed on the renter in respect to offenses committed by the driver and / or passenger during the rental period. Fines, penalties and other measures and the costs arising from this, including but not limited to the administration costs of Paulina Car Rental and / or third parties, are exclusively for the account of the tenant.

Article 6: The renter must handle the vehicle in a respectable manner. The renter ensures that the vehicle is used for its purpose. The costs associated with the use of the vehicle, such as costs for fuel, cleaning and parking, will be borne by the renter during the rental period. The renter may not rent out the vehicle to a third party. The renter may not use the vehicle for driving lessons. The renter may not compete with the vehicle in any form of racing or competitions. The renter may not use the vehicle for commercial passenger transport. The renter may not use the vehicle to commit or cause others to commit criminal offenses. The renter may not use the vehicle for the transport of flammable, toxic or otherwise dangerous or prohibited substances. If the renter detects damage or defects, the renter is not permitted to use the vehicle if this can lead to a worsening of the damage or defects or a reduction in road safety. The renter is obliged to report as soon as possible any known and observable defects, damage to the vehicle, loss or theft of the vehicle. The renter must keep the oil level and tire pressure at the proper levels. The renter must comply at all times with the applicable legislation and traffic rules. The renter will attempt to drive exclusively on paved roads. The use of unpaved public roads that lead to public or private beaches (which are accessible for a fee) or national parks is also permitted if these roads are easily accessible and open. Closed roads may never be used. It is forbidden to use alcohol and / or narcotics and / or medication during or before the ride that (may) affect the ability to drive. If the driver is under the influence of alcohol and / or narcotics and / or medication at the time of damages caused, the renter will be held liable for this damage and the full amount for the damage(s) will be charged to the renter.

Article 6a: The tenant is liable for all damage(s) to the rented property that are the result of a shortcoming attributable to him if he fails to fulfill an obligation from the rental agreement. If damage has arisen as a result of acts or omissions in violation of Article 6, or due to irresponsible driving behavior, intentional acts or omissions, intentional recklessness, or gross negligence of the renter (including if the driver is under the influence of alcohol and / or narcotics and / or medicines that (may) influence the ability to drive have caused a collision and / or accident), the entire damage will be recovered from the tenant. If the car is being driven off-road, a minimum of USD 140.00 for engine cleaning costs will be charged to the renter. The owner, Paulina Car Rental, reserves the right to have the insurer investigate an alleged violation or violation of the exclusions referred to in this article. In the case of police and / or witness statements, statement of CRS or otherwise legally acceptable burden of proof that indicate a shortcoming on the part of the renter, the renter is fully liable for damage to third parties and for damage to the rented property.

Article 7: The renter must comply with a call from Paulina Car Rental to offer the car for regular maintenance. Such a call from Paulina Car Rental will be made in time so that the renter can reasonably meet it. With a rental period of one month or less, the renter is not obliged to offer the vehicle for regular maintenance.

Article 8: The cars of Paulina Car Rental are insured by means of a Basic Legal Liability Insurance and additional hull coverage (by Inter Assure) with a maximum Basic Legal Liability Insurance coverage of NAF 150,000. The renter has been informed about this and upon entering into the lease agreement agrees with this insurance coverage and the insurance conditions. A deductible of USD 500 applies per claim. Damage in excess of the Basic Legal Liability Insurance coverage of NAF 150,000 will be fully recovered from the renter, who indemnifies the lessor against all costs in the event of damage. The renter acknowledges being liable for all damage caused to the rented property, regardless of whether this damage was caused by negligence, carelessness, gross negligence or intent during the use of the rented property. Glass damage and / or breaks, crack(s) in windshield, punctured tire(s), damage to rim(s) or wheel cover(s), broken chassis, as well as interior damage are excluded from any cover and will be borne entirely by the renter The loss or damage to keys and / or remote control is entirely at the expense of the renter with a minimum of USD 150. Damage that is not reimbursed by the insurer on the basis of the policy conditions will be recovered in its entirety from the renter.

Article 9: The renter is obliged to lock the car at all times when parking. The vehicle may never be left unattended if the vehicle is not locked. The renter is liable for damage as a result of not locking the vehicle. No valuable objects (visible or invisible) may be left behind in the vehicle.

Article 10: The renter is liable for all damage caused by theft as well as all other damage caused or caused to the rented property, regardless of whether the damage was caused by acts or omissions of the renter or third parties. In the event of damage, Paulina Car Service must be informed at all times and a damage form must be completed by the Curaçao Road Service (199). After an accident, the car may not be moved from the place where the accident occurred. If the above requirement is not met, all the insurer's right to compensation will lapse and the entire damage will have to be paid by the renter. In the event of theft or loss, the renter will be charged the deductible amount of USD 500. In the event of theft, the renter must hand over the key to the Paulina Car Rental. If the renter cannot provide the key, the current value of the car will be recovered from the renter. In the event of non-immediate payment of the total damage, not only the costs of the deductible but also all recovery costs are for the account of the renter.

Article 11: In the event of a car breakdown during the rental period through no fault of the renter, Paulina Car Rental will ensure that the vehicle is repaired within 7 working days. From the moment a report is made with the emergency number, the recovery time starts. If repair is not possible, then Paulina Car Rental offers replacement transport if possible. The renter is not entitled to replacement transport if the damage was caused by acts or omissions in violation of article 6, or by irresponsible driving behavior, intentional acts or omissions, intentional recklessness, negligence, or gross negligence on the part of the renter ( including if the driver was under the influence of alcohol and / or narcotics and / or medicines that (may) influence the ability to drive has caused a collision and / or accident). If the above solutions are not possible for any reason whatsoever, then Paulina Car Rental will offer a refund of the rental amount for every unused day.

Article 12: If the vehicle is returned early, the renter remains liable to Paulina Car Rental for the fully agreed rent. There is no refund of the agreed rent. If the time is exceeded without Paulina Car Rental being informed, the hours will be charged pro rata. If the vehicle is not picked up on the agreed date, Paulina Car Rental is entitled to terminate the agreement without refund of the deposit.

Article 13: Paulina Car Rental reserves the right to cancel under certain circumstances, including explicitly included weather conditions, without mutual costs. This will be done if, among other things, the safety of the renter is at risk, and is entirely at the discretion of Paulina Car Rental.

Article 14: At the conclusion of the rental period, if there is no damage, the renter will be reimbursed the deposit of USD 500 by Paulina Car Rental. The main driver is responsible for all co-drivers. The deposit can be paid in cash, by credit card or by bank transfer. Paulina Car Rental is entitled to settle the amount of any compensation with the deposit. The deductible per claim has been set at USD 500. In the event of damage, Paulina Car Rental will make an inventory of the amount of compensation to the renter. Any remaining part of the deposit that remains after deduction of the compensation will be returned to the renter in cash or by bank transfer. When it is established that there is no damage, the renter will receive the full deposit back. If it appears that there is no damage to the rented property, the renter will receive the full deposit back in cash or by bank transfer.

Article 15: The renter will take care of the rented property and treat it properly. Paulina Car Rental is at all times entitled to take the rented property after alleged abuse without refund of the rent. For long-term rental, the renter must have the inside and outside of the rented car washed on a monthly base at the location of Paulina Car Rental. The costs for this are USD 20 / NAF 35 and are for the account of the tenant. 

Article 16: These General Terms and Conditions have been published by Paulina Car Rental in Curaçao. The law of Curaçao applies to the relationship between renter and Paulina Car Rental. The competent court is the court in Curaçao. Disputes with regard to this agreement or with regard to everything related to it or resulting therefrom, will only be submitted to the competent court in Curaçao. You are requested to read these conditions carefully before making a reservation.
